Chief Justice Black once dissented that it is better to set one hundred guilty men free, than it is to send one innocent man to prison!
What has happened to our system of justice since the early 60's is atrocious! It's no wonder that our prison system is bursting at the seams. Our Country should be moving forwards, not backwards! While new technology such as D.N.A. has helped to free many innocent men across the United States, it has fallen far short of offering any type of relief to prisoners wrongfully convicted.
In the instance case William Burns presented "an alibi defense" and the authorities lied, withheld critical evidence, and the courts have continuously ignored the true facts of the case. When you "know" that it's wrong, it's WRONG!
Lee Jameson Heise filed three separate motions for discovery. Judge Pickard ORDERED the prosecutor to comply with the third motion. The prosecutor failed to comply! Deputy Bob Bratten reviewed the City of Northwood, Ohio's file and claimed there was nothing requested by the defense there. Judge Pickard offered Burns a continuance in order for discovery to be complied with. Based on Bob Bratten's findings defendant Burn's stated "I don't see where that would do any good!" Defendant Burns would have also had to waive his right to a speedy trial.
Only thru another case, another defendant's attorney years later, did defendant Burns discover Deputy Bob Bratten lied, and perjured himself at trial. Evidence did exist and it had been sent directly to him. The court has adopted the position that it offered the defendant a continuance - and the information was discoverable prior to trial.
Off the record, Judge Timothy Pickard was overheard commenting "There's something terribly wrong with this!" Defendant Burns rejected plea offers of 10-years, 5-years, then 2-years with credit for 6 months served.
After a 3 day trial, he was convicted by jury, and Judge Pickard sentenced him to serve LIFE in prison.
